We are certificated Enforcement agents and we have spent our working life helping landlords evict tenants commercially as well as residentially. We can provide you with advice on how to evict your tenant and in what case you can serve a Section 8 Notice or Section 21 Notice.

We as a company do not call or purport to be solicitors therefore we do not need to be regulated by the law society. Your claim in court for tenant eviction when necessary will be conducted by a practicing Solicitor.

CMD Enforcement will serve notice on the tenant, which notice will depend on the current situation the landlord is facing regarding the tenant in question, the two difference notices can be seen below;
- Section 8 Notice – a notice that tells the tenant he/she has 14 days to pay his rent or claim possession under grounds for nuisance, noise or breach of tenancy, such as non payment of rent.
- Section 21 Notice – this is a two-month notice that tells the tenant you are ending his/her agreement. This can be for any reason.
We have over a 90% success rate using our stage 1 process, if however, this fails we will then look at court proceedings to obtain a possession order and/or a money judgement from the County Court.
If the tenant has not left the premises after the date set by the judge (usually 14 days) we will then instruct bailiffs (now known as Enforcement Agents) to physically remove them from the property, this through the county court can take a number of weeks, Collect My Debt can fast track this through the high court.

Why should I use CMD Enforcement?
A legal notice coming from a legal company gives the tenants the extra incentive to either pay the rent or move out of the property. As a landlord you get peace of mind that the notices that are being served are correct and in order.
How do you serve the notice?
Under the court procedure rules there are different methods which will suffice, first class post, handing it to the tenant or putting it through their letterbox. Recorded or signed for delivery is not recommended as the tenants can refuse to sign the letter, the key is making sure the letter has entered the property and therefore it will be deemed as served.
What happens after notice is served?
Once the notice is served we request the tenants to contact us if they have any questions or need any clarification. After 14 days (S8) or Two months’ (S21) we will contact you to find out whether the tenant has paid the rent or has vacated the property or not. If the tenant has done neither we can discuss the next step, which is starting court proceedings.
How long does it take to get a tenant into court?
In most cases, it can take around 6 to 10 weeks to get a tenant into the courts, however this can vary from court to court.
What happens once I obtain a court order?
Once a court order has been obtained then the tenant should leave by the date set by the courts. if the tenant has not left then we move to stage 3 where enforcement agents will attend to physically remove the tenant.
Which court will you use?
Usually, it is the nearest county court to the property in question that is used to issue the claim.
The court closest to the property is the court where the claim will take place. How long does this procedure take?
The court procedure can vary depending on what county court the claim has been issued in, the London courts are generally more busier than others, but on average the court procedure takes between 6-8 weeks, this can be fast tracked through the high court when the debt is over £600.00 for a small cost, but is a lot faster than waiting for the county court, meaning the landlord can get his property back and re-let it sooner saving money and time.
Will I receive anything from the court?
You will receive a possession order and also a money judgment order (rent arrears) from the county court judge. The possession order is normally a 14 day order in which the tenant has to vacate the property by.
What happens if the tenant doesn't leave after the possession order date has expired?
This is when we will send in the bailiffs with a locksmith to physically remove the tenant and change the locks so if the tenant tries to re-enter the property then it becomes a criminal offence.
Do I need to do anything or get involved on the date of eviction?
No, rest assured you can sit back knowing CMD Enforcement have made all the arrangements for the tenant to be promptly evicted and the property secured.
After the tenant has been evicted, they still have possessions at the property and want to remove them, what is the best way to give them access?
Once the tenant has been removed from the property only taking essentials, they may soon wish to re-enter the property to remove their other goods, which they have right to.
CMD Enforcement would highly recommend a supervised access.
A supervised access is when a Certificated Enforcement Agent will attend site to meet with the ex-tenant to let them onto the site and supervise while they remove goods, this prevents the ex-tenant who may well be very disgruntled from causing damage to site or indeed squatting on site, then causing the landlord massive legal and/or repair costs.

It is a pleasure to recommend CMD Enforcement for all their hard work and efforts in removing some very nasty tenants from a number of my properties.
I have had a number of issues past and present with tenants refusing to pay their rent and thinking it is ok for them to live in my property rent free a few paid at stage one which was fantastic as it meant that I got the due rent paid.
